TERMS AND CONDITIONS

PREAMBLE

The www.mobhotel.com website, hereinafter referred to as "the site" is a hotel and restaurant booking tool that will soon feature an e-commerce component.

It is published by the SAS FINANCIAL MOB, hereinafter referred to as MOB HOTEL, with capital of € 6,147,379 whose registered office is at 77 Boulevard Malesherbes - 75008 PARIS and which is registered in the Paris Register of Trade and Commerce under number 527 676 043 00013.

The site is free to access. It is aimed at the general public, hereinafter referred to as "users".

For the purposes of these terms and conditions of sale, it is agreed that the customers and MOB HOTEL will be collectively referred to as the "Parties" and individually as a "Party" and that a user who has confirmed a reservation or an order will be referred to as a "customer".

These terms and conditions of sale apply to all countries and all currencies. Any reservation or order implies total acceptance of these terms and conditions of sale.

MOB HOTEL reserves the right to modify these terms and conditions at any time by posting a new version on the Site. The applicable terms and conditions of sale are those in force at the time of booking or placing the order.

ARTICLE 1: GLOSSARY

"Confirmation e-mail": E-mail sent by MOB HOTEL, in the final stage of the booking or order process. It summarizes the reservation confirmed by the customer and confirms its receipt by the www.mobhotel.com site. The confirmation e-mail constitutes a reservation confirmation as defined below.

"Reservation confirmation": Digital document that summarizes the services reserved at the end of the booking process and its confirmation by the Customer. The reservation confirmation is sent after a reservation is made on the www.mobhotel.com website, during which a credit card number is entered for an online payment or deposit before proceeding with final confirmation.

"Establishment Contract" Contract covering the provision by MOB HOTEL establishments of all the services defined below and which have been ordered by the Customer after confirmation of the online reservation or by another reservation method.

« Customer » : Natural person with full legal capacity at the time of entering into the Establishment contract.

« Reservation request » : Request for reservation of rooms or restaurant tables, made by the customer by mobile communication services or internet.

« Mobile services » : All services and protocols allowing mobile phones to connect to the Internet, and allowing the services provided by MOB HOTEL to be viewed and booked.

« Online booking » : Reservation of rooms, restaurant tables and any additional accessories or services offered by MOB HOTEL establishments on its www.mobhotel.com website.

« Booking by phone or e-mail » : Reservation of rooms, restaurant tables and any additional accessories or services offered by MOB HOTEL establishments by the Customer making a phone call or sending an e-mail, in line with the reservation process as described in these terms and conditions of sale.

« Establishment(s) » : Designates one or more MOB HOTEL establishments including rooms, restaurants or other ancillary services offered on the www.mobhotel.com site.

« Services » : Services marketed by MOB HOTEL consisting, under the contract with the Establishment, of the provision of rooms whose main features are presented on the www.mobhotel.com site with or without provision of food and/or breakfast and other additional services related to temporary accommodation, including artistic entertainment. In accordance with Article L. 111-1 of the Consumer Code these services appear on the www.mobhotel.com website.

« Extras » : Services marketed by MOB HOTEL consisting, under the contract with the Establishment and the customers, of different services that are complementary to those offered as part of the provision of rooms whose main features appear on the www.mobhotel.com website.

« Website » : electronic service operated by MOB HOTEL on the internet and accessible via the following URL: www.mobhotel.com.

« WAP » : communication protocol that provides access to the Internet using a mobile terminal.

ARTICLE 2 : SCOPE OF APPLICATION

2.1 Scope

These terms and conditions apply without restriction or reservation to all services offered on the www.mobhotel.com website by MOB HOTEL operating the aforementioned site, in particular with regard to the reservation of rooms and other services that are complementary to temporary accommodation in the establishment.

2.1.2. These Terms and Conditions apply to all bookings or orders made by the Customer for the services defined above.

2.2 Territory

The services provided on this website are to be provided to the Customer by MOB HOTEL in one of its establishments to the exclusion of any other location following a booking carried out by the Customer.

2.3 Duration

2.3.1. These terms and conditions apply throughout the duration of the time the services are advertised online by MOB HOTEL on its website www.mobhotel.com

2.3.2. MOB HOTEL reserves the right to temporarily or permanently close the www.mobhotel.com website or online reservation area, without notice or compensation.

2.3.3. MOB HOTEL is not liable for damages of any kind that may result from a temporary unavailability or permanent closure of all or part of the site or the services associated with it, such as the online reservation area.

2.4 Legal regime

2.4.1. These terms and conditions are subject to the provisions of Articles L.121-16 et seq. of the Consumer Code.

2.4.2. All reservations for the services defined above, carried out on the www.mobhotel.com website is subject to these terms and conditions and special tariff conditions for each of the MOB HOTEL services indicated below.

2.5. Purpose

2.5.1. These terms and conditions set out the rights and obligations of the parties with regard to remote reservation of the services offered by MOB HOTEL on its website www.mobhotel.com

2.5.2. They cover all the steps required to make a reservation, and follow up the reservation between the contracting parties, its maintenance and its validity.

ARTICLE 3: CUSTOMER CAPACITY AND ACCEPTANCE

3.1. Each Customer acknowledges having the capacity to enter into a contract under the conditions described in the terms and conditions set out below, that is to say that they are of legal age and not under guardianship. However, the Management of the Establishment reserves the right to ask the Customer to provide an identity document showing their date of birth, on arrival in the Establishment.

3.2. The Customer acknowledges that these terms and conditions are an integral part of the Establishment contract.

3.3. The Customer accepts that the terms and conditions, contractual documents containing information about the services and special tariffs of each service, as well as order forms and instructions for placing an order, are made available to the Customer online on the www.mobhotel.com website for the purposes of entering into an Establishment contract.

3.4. The Customer confirms that s/he has obtained all the necessary information from MOB HOTEL on the www.mobhotel.com site.

3.5. The Customer acknowledges having read these terms and conditions and having accepted the same, as well as all the terms of the proposal, before placing the order and having accepted all the terms.

3.6. Any confirmation of online booking on the www.mobhotel.com website by the Customer assumes the prior consultation and acceptance of these terms and conditions.

3.7. The Customer agrees to these terms and conditions during the booking process, prior to confirmation of the booking.

3.8. Prior to ordering the services the Customer states that the reservation of such services are for his/her personal use.

3.9. The Customer is able to save and print these terms and conditions from the www.mobhotel.com site using the standard functionality of their browser and/or computer, under the "T&C" tab.

3.10. The Customer expressly accepts that entering the required bank information, acceptance of these terms and conditions and confirmation of the reservation request, all constitute an electronic signature within the meaning of Article 1316-4 of the Civil Code which, between the parties, has the same value as a handwritten signature.

3.11. Following presentation of his/her identification as referred to in section 3.1 above, the Customer undertakes to complete the individual police form in the countries relevant to this article, in accordance with Article R.611-42 of the Code for Entry and Residence of Foreign Persons.

ARTICLE 4 : WEBSITE CONTENT

4.1. The site features the following information:

  • The identification of the company MOB HOTEL stating its name, registered office and e-mail address.
  • The main features of the proposed accommodation (the descriptions of each category of rooms offered can be viewed without reservation under the "ROOMS" tab for each of the establishments concerned, during the booking process under the room availability calendar and when choosing a room for the dates selected by the Customer for the booking, these features may be illustrated by a photograph of a room at the same rate. It is however specified that THE PHOTOS ARE NOT CONTRACTUALLY BINDING insofar as the internal presentation or decoration as well as the sizes of the rooms differ within an establishment or from one establishment to another).
  • The price of each service relating to accommodation and additional services.
  • Payment terms.
  • The terms and conditions of sale.
  • The period for which the offer remains valid, and its price.
  • The minimum duration of the proposed contract, if applicable.
  • The absence of a right of withdrawal and cancellation terms where applicable.

4.2. All information on the www.mobhotel.com website appears in French and English.

ARTICLE 5 : BOOKING

5.1. Online booking terms

5.1.1. The Customer selects the services featured on the www.mobhotel.com website, which allows reservation of a room or a table, in line with transparent contractual rates with or without options or Extras which the Customer is free to select if desired.

5.1.2. The Customer acknowledges the nature, destination and booking details of services available on the www.mobhotel.com website and acknowledges having requested and obtained the necessary and/or complementary information to make a fully informed reservation.

5.1.3. The Customer alone is responsible for the choice of services and their suitability to his needs, such that MOB HOTEL cannot be held responsible in this regard.

5.1.4. The reservation is deemed accepted by the customer at the end of the booking process by clicking on "CONFIRM RESERVATION".

5.2. Online booking process

5.2.1. The reservation is confirmed upon receipt by the customer of the reservation confirmation sent by MOB HOTEL, or when paying online by credit card under the conditions referred to in Article 5.2.4. A confirmation screen will then appear online.

5.2.2. The Customer undertakes to complete the requested information prior to any reservation.

5.2.3. The customer confirms that the information provided is true and accurate.

5.2.4. The booking procedure is secured as provided for Article 9 below and includes the following steps, it being specified that the Customer is always able to reverse the booking process:

  1. Choice of location: the Customer clicks to choose the establishment and location.
  2. Choice of start date (arrival) and end date (departure)
  3. If the arrival and departure dates are not provided, a calendar appears showing the available or full days for the establishment previously selected. For each available day the calendar shows the best available rate under the date. This shows the customer the best available rate per night. By clicking on dates, the Customer can select the day of arrival and departure and then progress to the next steps.
  4. Choosing the number of rooms booked: The Customer clicks to choose the number of bedrooms chosen for the dates of his/her stay. When booking multiple rooms the booking process is carried out room by room.
  5. Choice of number of adults per room: The Customer clicks to select the number of adults per room.
  6. Choice of number of children per room: The Customer clicks to select the number of children per room.
  7. Choice of rooms and relevant rates: The Customer clicks to choose from the various rooms and rates available based on the information entered in the previous steps, including their main features, such as category of room on the date previously chosen, price, level of facilities, any Extras included for special offers, cancellation policy, and payment conditions. Note that photographs and images shown on the site are not contractually binding.
  8. Choice of Extras: with a simple click and subject to availability, the customer can add one or more extras suggested based on information entered in the previous steps. These extras display prices, quantities and special features. By clicking "add" or "add an item" the Customer completes the selection of the online reservation without prejudice however to modifying parts of the reservation by going back through the previous booking process.

Finalizing the reservation: by clicking on the button "confirm my reservation", the customer confirms the summarized information displayed that makes up his/her reservation and the fields appear for the Customer to enter his/her name, contact information, postal address, e-mail and phone number, type of stay, and the payment method and details of the bank card used for online payment, provision of a guarantee based on the tariff selected by providing bank card details; acceptance of these terms; final confirmation by the Customer of his/her reservation by clicking on the "Confirm reservation" field at the bottom of page. Before confirming the reservation, the Customer can write in a "special requests" field if they have a request for clarification or a special request, which is not contractually guaranteed by MOB HOTEL without a written response to the request agreeing to provide the requested service with an indication of its price if applicable for acceptance by the Customer. By clicking "Confirm reservation" the customer pays or provides a bank card guarantee based on the tariff reserved. Last step: MOB HOTEL records the reservation made by the Customer and assigns a booking confirmation number.

5.3. Conclusion of the Contract Online

5.3.1. In accordance with Articles 3.10 and 5.2.4, the Establishment contract is concluded when MOB HOTEL confirms the Customer's reservation including the relevant reference number as referred to in the previous article.

5.3.2. Conclusion of the Establishment contract can only occur after the Customer has selected the content of his/her reservation which is completely summarized in last step of the booking process, he/she must have accepted these general conditions and confirmed the reservation by clicking on the "Confirm reservation” button. Otherwise the reservation is deemed to be cancelled and will have no effect.

5.3.3. In every case of online booking, a summary e-mail is sent to the Customer to the e-mail address provided in the field reserved for this purpose. This e-mail constitutes an acknowledgement of receipt of the reservation and the reservation confirmation which summarizes the terms of the contract, the services reserved, prices, price conditions related to the tariff selected, information about after-sales service and commercial guarantees if applicable, conditions of exercise of any right of withdrawal or cancellation, and the MOB HOTEL address for any customer complaints.

Other reservation methods (offline)

5.4.1. Booking by phone

5.4.1.1. Telephone reservations as defined below are carried out on the telephone numbers provided.

5.4.1.2. When the Customer books over the telephone, MOB HOTEL provides the tariffs available and relevant additional services based on the Customer's request for the dates required. MOB HOTEL also asks for a telephone number and an e-mail address where MOB HOTEL can send these terms and conditions of sale as well as the booking summary, and, where applicable, request bank details to make the reservation, with or without payment during the booking process of the price, a deposit or a bank card guarantee based on the applicable tariff determined by the Customer when making the reservation request.

5.4.1.3. All information and conditions required by MOB HOTEL in response to the Customer telephone reservation are essential to record the Customer's telephone reservation. Otherwise the reservation cannot be validated or confirmed.

5.4.1.4. As the information required by MOB HOTEL is sent at least by e-mail, the Customer may not complain of the reservation not being recorded if the Establishment contract is not concluded due to his failure to provide such information and conditions. Only written confirmation of the reservation record will constitute conclusion of the contract.

5.4.3. Booking by e-mail

5.4.3.1. Reservation by e-mail as defined below is carried out to the e-mail addresses found on the pages of each establishment's website: helloparis@mobhotel.com ou hellolyon@mobhotel.com

5.4.3.2. When a reservation is requested by e-mail, MOB HOTEL sends the tariffs available and relevant additional services based on the Customer's request on the dates he wants, by return e-mail to the address from which the reservation request was sent. MOB HOTEL also sends these terms and conditions of sale by return e-mail as well as the booking summary, and, where applicable, request bank details to make the reservation, with or without payment during the booking process of the price, a deposit or a bank card guarantee based on the applicable tariff determined by the Customer when making the reservation request.

5.4.3.3. All information and conditions required by MOB HOTEL in response to the Customer e-mail reservation are essential to record the Customer's telephone reservation. If the Customer, having made a reservation request by e-mail, does not comply with the provisions of these MOB HOTEL terms and conditions of sale, the Customer may not complain that his/her reservation has not been recorded. Only written confirmation of the reservation record will constitute acceptance.

5.5 Right of Withdrawal / Cancellation by the Customer:

5.5.1. The Customer is reminded, in accordance with Article L. 121-20-4 of the Consumer Code, that he/she does not have the right of withdrawal as provided for in Article L. 121-20 of the Consumer Code, since the services are provided on a date or at a specified time.

5.5.2. Without prejudice to the provisions referred to in Article 5.5.1, the contractual conditions may, where applicable and depending on the content of the booking confirmed by the Customer, and as indicated for each tariff, lead to a right of cancellation when the booking is made under the title of "Tarifs flexibles / Flexible rate”. In this instance, the Customer is made aware of the relevant cancellation conditions. The customer is also reminded of the conditions at the various stages leading up to payment.

5.5.3. If the special conditions of the tariff permit, either for single bookings made under the title of "Tarifs flexibles / Flexible rate", or another title that specifically mentions this right of cancellation, the right of cancellation by the Customer must be carried out before 6pm the day before his arrival - Paris time (France). Late cancellation notification results in the application of a late cancellation fee of an amount equal to the first night's accommodation, plus any extras included in the Customer’s booking, according to the applicable tariff including VAT in the reservation confirmed by the Customer.

5.5.4. The right of cancellation defined in Article 5.5.2 may be invoked by the Customer on the www.mobhotel.com website on the My Account page after logging in using the confirmation number or e-mail and a password. The Option tab then allows the reservation to be cancelled. By clicking the OK button, the cancellation will take effect immediately and all fees associated with this reservation will also be cancelled. A cancellation confirmation e-mail will then be sent to the customer.

5.5.4.1 Depending on the offers selected by the Customer, cancellation by phone may also be possible. This must be accompanied by an e-mail from the Customer and will be followed by a cancellation confirmation e-mail from MOB HOTEL.

5.5.5. In the event of an interruption to the stay, the full agreed price will be charged without the right to a refund, credit or exchange for the Customer for the unused portion of the stay at the Establishment. In the event of booking with payment during the booking process, no refund will be given.

5.5.6. Unless expressly provided otherwise, in particular in the event of buying extras for this purpose, the customer must check out of the room by midday on the day of departure. Failing this and subject to availability, a late check-out will be offered. This will be charged 50% of the reference price for the room on the day of late check-out. This pricing will end at 6pm French time. After this time, an extra night will be billed. The tariffs for the overnight stay will vary depending on the room occupied and the day encroached on. In the event of non availability of the room, MOB HOTEL reserves the right to access the room while still occupied to prepare it for the new arrivals.

5.5.7. Without prejudice to the application of the right of cancellation under the terms of Article 5.5 for "Tarifs flexibles/Flexible rate”, should the Customer not attend the Establishment or in the event of a no show (reservation not cancelled if there is a right of cancellation and the Customer does not arrive) without previously informing the Establishment so they can re-take possession of the reserved room, this results in release from the reservation as a whole, the nights booked are once again made available and the cost of the first night of the stay is automatically payable, including all the extras reserved, including taxes without the Customer having any right to a refund.

5.5.8. The conditions referred to in Article 6 shall prevail whatever the method of reservation: internet, e-mail, telephone or social networks.

ARTICLE 6 : TARIFFS and PRICES

6.1. Prices relating to the reservation of services are indicated before and during the booking process. Prices are valid in real time and are displayed in accordance with Article 5.2.4. Similarly, for other methods of reservation by telephone or e-mail, tariffs are valid at the time of the Customer's reservation request. They are also available under "view available tariffs on the calendar". In any case, tariff special conditions related to each tariff/room type, or additional services, are displayed opposite each of the services booked by the Customer.

6.2. Prices shown are per room, per adult, it being specified that the tariff chosen automatically implies Customer check-in at 3pm and check out at midday, unless an “extra” has been purchased for this purpose. At check-in, a credit card is pre-authorised and a piece of identification must be provided. At check-out in the event of a no show, MOB HOTEL reserves the right to charge the credit card pre-authorised on check in.

6.3. Prices are subject to VAT and are displayed including VAT at the prevailing rate at the time of booking confirmation, in Euros or in the currency selected by the customer. Prices displayed are valid only for the period indicated on the website.

6.4. If payment is made in a currency other than the currency of the customer's home country, the exchange costs will be borne by the customer.

6.5. All reservations are payable in Euros as specified during the booking process.

6.6. Unless otherwise specified, additional services such as breakfast, terrace, air mob pass and any other extras selected, are not included in the price. However the price of these additional services confirmed in the Customer's booking is payable during the online or offline booking process as it is a different tariff than the "Tarifs flexibles/Flexible rate". These tariffs are subject to VAT at the rate in effect at the time of booking, if necessary, depending on the regulations applicable to those categories of goods or services subject to a different rate than that applicable to room reservation.

6.7. Tourist tax:
Paris : 1.65€ per adult / night
Lyon : 1.10€ per adult / night

6.8. Prices include the VAT applicable on the date of the order and any change in the VAT rate will be automatically reflected in the prices indicated, in particular in the event of a change in the applicable rate on the day of the stay and any Extras purchased compared with the rates applicable at the time the booking was made.

6.9. If a tariff means that payment is made at the Establishment at the time of arrival or departure and the currency of the customer is not the same as that of the country in which the Establishment is located, the price charged by the latter may differ from that given at the time of booking, given possible changes in the exchange rate between the booking date and the dates of the stay at the Establishment.

6.10. Any object removed from the room during the stay will be charged at the current rate. Rates are available at the reception of each establishment.

6.11. In the event of damage to the room, communal areas or miscellaneous items, MOB HOTEL reserves the right to charge the customer for the price of the damage caused.

ARTICLE 7 : PAYMENT

7.1. The Customer provides his/her bank details to guarantee the reservation except in the event of special rates requiring payment online as stated during the booking process and in particular those sold as "internet, best available rate".

Payment information is secured by SSL encryption. The following information will be required to finalize your reservation: card number, expiry date and security code as part of an online payment via the payment platform for this purpose. This also applies to bank details sent as part of a telephone or e-mail booking in accordance with the formal requirements that involve either a payment on booking, or the requirement of a credit card pre-authorisation guarantee depending on the booking tariff.

7.2. The payment is made at the Establishment during the stay, except in the event of special conditions or tariffs where payment is made when booking for certain tariffs subject to the requirement of payment during the reservation process according to specific contractual conditions previously accepted by the Customer.

7.3. The service provider chosen by MOB HOTEL for secure online payments by bank card, checks the validity of the customer's payment card. The payment card may be refused for several reasons: stolen card, blocked card, ceiling reached, data entry error, etc. In the event of difficulty or impediment, the customer must contact his/her bank to identify the cause, and contact the Establishment to confirm the reservation and payment method.

7.4. If the customer reserve multiple rooms but payment, online and in any case during the booking process, is only required for a single room, for example, in this case, the payment card that is used on the payment platform allows payment of the room concerned by online payment and a guarantee during the booking process for the other rooms.

7.5. When payment is made online and in any event when required during the booking process, the amount debited on booking includes: the price of accommodation, taxes related to the accommodation, the price of additional services or "extras".

7.6. In the event of a tariff subject to online payment, the payment is debited when the Customer completes the booking following a computerized online payment process.

7.7. Following a stay in one of the MOB HOTEL establishments and regardless of how the booking was made, an invoice is issued in duplicate by MOB HOTEL a copy of which is delivered or sent by e-mail to the Customer on their departure from the Establishment.

7.8. During the Customer's stay, when the payment has not already been made online and in any case during the booking process, and the amount of the Customer's invoice exceeds the value of 400 Euros, the Management will require payment for the service provided in respect of that stay, in the manner provided for in Article 7 hereof.

7.9. Payment by cheque is not accepted whether the provision is of temporary accommodation and/or catering services and/or any other services or sales of products supplied by MOB HOTEL to the Customer during their time in the Establishment.

7.10 In any event, any "Extras" or other service that has been booked and delivered by MOB HOTEL during the Customer's stay and which has not been pre-paid during booking must be paid for by the Customer at Check-out at the latest.

ARTICLE 8 : COMPLAINTS

8.1. Any Customer complaints should be sent by letter or e-mail to the relevant Establishment:

8.1. MOB HOTEL guarantees adequacy of the services, under the conditions laid down in Articles L.111-2. of the Consumer Code, without prejudice to any additional contractual guarantee that may be agreed between the parties outside of these terms and conditions, according to a written contract signed by the parties.

8.2. MOB HOTEL undertakes to ensure that the photographs, graphics and text provided give as accurate a picture as possible of the provision of accommodation, catering and other additional services offered. However, Photographs are not contractually binding, firstly because the various rooms have different dimensions, even when they have the same tariff, and also because variations may occur, especially due to a change of furniture, new decoration or any renovations. Subject to availability, unless a reservation has been made with an express request for allocation of a particular room and this has been confirmed in writing by MOB HOTEL, the Customer may not complain in this regard, since such variations do not relate to the essential characteristics of the service.

8.3. MOB HOTEL cannot be held responsible for non-fulfilment or improper fulfilment of the reservation in the event of force majeure, due to a third party, due to the customer or due to its partners such as the unavailability of the Internet network, inability to access to the website, external intrusion, computer virus or in the event of online payment refusal by the holder's bank to authorize the transaction.

8.4. Although MOB HOTEL offers in the Establishment, and more particularly in the rooms, the restaurant and the KOLKHOZITA area, a wifi internet access service, in the event of total or partial failure of this service for any reason whatsoever that is not the fault of the Establishment, during the stay in the Establishment, this should not any right of the Customer to cancel the booking, nor to reimbursement for the booking or any compensation whatsoever.

8.5. MOB HOTEL shall not be held liable for any indirect and/or consequential damage, including loss of profit and operating loss, due to a third party, due to the customer or due to its partners.

8.6. Hypertext links on the www.mobhotel.com website may link to sites other than the MOB HOTEL website, which cannot accept any responsibility for the contents of these websites and services offered.

8.7. Safety deposit boxes are available for guests in each room. Under no circumstances will the Establishment be held responsible for theft or damage to valuables left by the Customer in the rooms or in vehicles parked in the Establishment’s car park.

8.8 MOB HOTEL cannot be held responsible for damage caused by animals in the Establishment, these shall be the responsibility of their owner or keeper in accordance with Article 1385 of the Civil Code. MOB HOTEL reserves the right to bill the owner or keeper for the cost of damage caused.

ARTICLE 9 : COMPUTERS, LIBERTY AND PRIVACY, IMAGE RIGHTS

9.1. The information requested from the Customer during the booking process, which isfully secure from beginning to end, is required to process the order and will be communicated to MOB HOTEL and/or its online payment provider.

9.2. In accordance with the provisions of Law no. 78-17 of 6 January 1978 relating to computers, files and liberty, each Customer has a right of access, modification, and correction with regard to information concerning them, as provided for by law and MOB HOTEL regulations. The Customer can also refuse the processing of the relevant information on legitimate grounds.

9.3. The customer is informed that all personal data collected throughout the booking process will be subject to automated processing for which the data controller is MOB HOTEL PARIS LES PUCES OR MOB HOTEL LYON CONFLUENCE depending on which Establishment is relevant to the reservation.

9.4. This data processing will allow MOB HOTEL to:

• fulfil its obligations to the Customer, by adding them to the Customer records;

• make the booking;

• inform the Customer by e-mail of special offers and any new similar service created by MOB HOTEL. The Customer can always opt out of this information by de-registering or refusing disclosure to third parties of personal data by clicking the relevant link on the booking confirmation e-mail sent to the Customer, as well as on the Customer record completed in the Establishment reception at check-in.

9.5. On each of the forms collecting personal data, the customer is informed of whether the questions are mandatory or optional, by the presence or absence of an asterisk.

9.6. In particular when paying online, the customer's bank details must be provided by the payment provider to the Establishment’s bank for the Establishment to fulfil the contract. The Customer is informed that this data transfer may therefore occur in foreign countries without an adequate personal data protection within the meaning of Law no. 78-17 of 6 January 1978 (art. 69). However, the customer agrees to the transfer in order to fulfil his contract. The payment service provider undertakes to MOB HOTEL to take all security measures and respect for data privacy for said data transfers.

9.7. The reservation of overnight stays and/or Extras in the Establishment concerned and their consumption by customers and/or their companions, or even the mere presence in the Establishment does not in any way authorize any audiovisual recording or photography both in the premises and outbuildings of the Establishment including the rooms, for commercial, promotional or advertising purposes, media relations or public relations, website illustration, etc. and more generally any collective use or liable to involve public use. The interior architecture of the graphic designs adorning the communal areas and rooms of the Establishment are protected by copyright, the rights of which are fully reserved. Any audiovisual recording, shooting, reproduction or representation of images featuring the premises and outbuildings of the Establishment concerned other than for private use is subject to prior authorization from MOB HOTEL under penalty of prosecution, including by the civil and criminal provisions of the Code of intellectual property.

9.8 Cookie policy

When you log on to our website, we may, subject to your settings, install one or more cookies for their legal period of validity.

The Cookies we issue have several purposes:

ARTICLE 10 : MISCELLANEOUS

10.1. These terms and conditions are governed by French law.

10.2. In the event that any provision of these terms and conditions should be declared null and void in any manner and for any reason whatsoever, it shall be deemed unwritten and shall not result in the nullity of any other provisions.

Any disputes that may arise between the parties in connection with the interpretation and/or fulfilment of these terms and conditions shall failing amicable agreement be subject to the exclusive jurisdiction of the court having jurisdiction in the Paris Court of Appeal, with the exception of disputes concerning non-commercial persons and for which the statutory rules for jurisdiction apply.

10.3. Please note that all rooms are non-smoking. If you light a cigarette inside MOB HOTEL, we will be obliged to charge a fine of 300 Euros to your credit card.

10.4. Decoration objects are arranged in our rooms. If you like them as much as us, you can buy them. If you leave, by chance, with one or more items, MOB HOTEL will directly debit your credit card. Our rates are available at the grocery store. Come to see us to buy them, it will be more friendly !
